This document governs the copyright/usage terms for the content you produce as a creator, the confidentiality provisions and your representations regarding the content.
1) Scope
This document covers the conditions for using the Content you produce through the form within the advertising, promotion and marketing activities of the Brand you specify in the form.
2) Assignment of Economic Rights / Licence
Where the Content qualifies as a copyrightable work, you agree to permit the economic rights — including adaptation, reproduction, distribution, performance and communication to the public — to be used in favour of the Company and/or the Brand, to the extent necessary for the relevant Brand's advertising/marketing activities.
Because of the "relevant brand only" restriction, this document operates in practice as a usage licence.
3) Term, Territory and Adaptation
The Content may be used worldwide, for the period stated on the form you uploaded it through (3 months, 6 months or 1 year; where the form states no period, 1 (one) year), counted from the delivery (upload) date, and without limitation of medium, solely in the relevant Brand's advertising/marketing activities. The period in force is written explicitly in the text you accept when approving the form, and is recorded. At the end of the period the right of use ends unless the parties extend it in writing. You permit technical adaptations required by the campaign, such as cropping, editing, format conversion and adding subtitles, provided they do not distort the essence of the Content.
4) Image/Voice and Personality Rights
You permit your own image and voice appearing in the Content to be published solely in the relevant Brand's advertising/marketing activities. If third parties appear in the Content, you represent that you have obtained the necessary permissions.
5) Representations and Liability
- That the Content belongs to you or that you hold the necessary permissions,
- That the Content does not infringe third-party copyright/trademark/personality rights,
- That the licences of any music/footage and other elements used are suitable for campaign use.
6) Confidentiality
The brief, budget, strategy, publication schedule and commercial information of the brand that you learn during the campaign are confidential; you agree not to share them with third parties. Sharing on your portfolio is only possible with the Brand's prior written approval.
Governing Law and Jurisdiction
This document is governed by the laws of the jurisdiction in which the Company is established, without prejudice to any mandatory consumer-protection or data-protection rules of your country of residence that apply to you. Any disputes arising in connection with this document shall be subject to the competent courts of the Company's place of registration, save where applicable law grants you the right to bring proceedings before the courts of your own jurisdiction.
